Welcome to Faded Lore. This website is operated by Saki Fire LLC, a Wyoming limited liability company ("Faded Lore," "we," "us," or "our"). By visiting our site or purchasing from us, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, please do not use our site.

1. Using Our Site

By using this site, you confirm that you are at least the age of majority in your state or province of residence, or that you have given consent for any minor dependents to use this site. You agree not to use our products or site for any illegal or unauthorized purpose.

2. Our Products

All Faded Lore products are printed on demand after you place your order. We make every effort to display product colors and designs accurately. However, because garment-dyed fabrics are dyed individually and screens display color differently, minor variations in color, texture and print placement can occur. This does not exclude genuine printing defects, damaged goods or items that differ from what you ordered from our Return & Refund Policy.

Sizing information is provided in our Size Chart. Please review it before ordering.

3. Pricing and Availability

All prices are listed in US Dollars (USD). We reserve the right to change prices, modify or discontinue products, and correct pricing or description errors at any time without prior notice. If an order was placed at an incorrect price, we will contact you and give you the option to confirm at the correct price or cancel for a full refund.

4. Orders

We reserve the right to refuse or cancel any order, including orders that appear to be placed by resellers or that show signs of fraud. If we cancel an order after payment, we will issue a full refund to your original payment method.

You agree to provide current, complete, and accurate purchase and account information, including your email address and shipping address.

5. Payment

Payments are processed securely through Shopify Payments and its partners. We do not store your full payment card details. By submitting payment, you confirm that you are authorized to use the payment method provided.

6. Shipping, Returns, and Refunds

Shipping times and costs are described in our Shipping Policy. Replacements, refunds, and cancellations are governed by our Return & Refund Policy. Both policies are part of these Terms. Contact us as soon as possible, ideally within 2 hours, for an order change or cancellation. Requests are not guaranteed, even within this time, and generally cannot be accepted once production begins. This does not limit the remedies in those policies or your rights under applicable law.

7. Intellectual Property

All designs, artwork, text, graphics, logos, photos, and other content on this site are owned by or licensed to Faded Lore and are protected by copyright and trademark laws. You may not copy, reproduce, resell, or distribute any of our designs or content without our written permission. Purchasing a product does not grant you any rights to reproduce its design.

8. Reviews and Submissions

If you submit reviews, comments, photos, or other content to us, you grant Faded Lore a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our business. You confirm that your submissions do not violate anyone's rights and do not contain unlawful, offensive, or misleading material. We may remove any submission at our discretion.

9. Prohibited Uses

You may not use our site to: violate any law; infringe on our intellectual property or the rights of others; transmit viruses or malicious code; collect other users' personal information; submit false information; or interfere with the security or operation of the site.

10. Third-Party Services and Links

Our site may include links to or tools from third parties. We are not responsible for third-party websites, products, or services, and your use of them is at your own risk and subject to their terms.

11. Disclaimer

Our site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose, except as expressly stated in our Return & Refund Policy or required by applicable law. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

12. Limitation of Liability

To the fullest extent permitted by law, Faded Lore, Saki Fire LLC, and its owners, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our site or products. To the extent permitted by applicable law, our total liability for any claim related to a product will not exceed the amount you paid for that product. These limitations do not reduce the refunds, shipping reimbursements or replacements expressly offered in our policies, or any liability that cannot lawfully be limited.

13. Indemnification

You agree to indemnify and hold harmless Faded Lore and Saki Fire LLC from any claims, damages, or expenses arising from your breach of these Terms or your violation of any law or the rights of a third party.

14. Privacy

Your use of our site is also governed by our Privacy Policy, which explains how we collect and use your information.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. If you have a concern, please contact us first at support@fadedlore.com — most issues can be resolved quickly and informally.

16. Changes to These Terms

We may update these Terms from time to time. Changes apply prospectively from the date posted. Orders already placed remain subject to the terms and policies in effect at the time of purchase, unless a change is required by law. Your continued use of the site after changes are posted means you accept the updated Terms for future use.
